A Fundraising raffle to support frontline NHS staff

Terms and Conditions

The NHSFEST Raffle was paused immediately following the original launch, due to technical issues caused by incredibly high demand. In order to: (i) ensure that even more robust systems are in place prior to the relaunch; (ii) maximise the benefits that the NHSFEST Raffle can provide to help the NHS and UK based charitable partners; and (iii) ensure legal compliance, following its relaunch, The Prince & Princess of Wales Hospice (PPWH) have partnered with a second Promoter, Myton Hospice (Promotions) Limited (MHPL), a wholly owned subsidiary of The Myton Hospices. Please click here if you wish to obtain a copy of the revised Terms and Conditions, but please be assured that any society lottery entries purchased as part of the initial offering will automatically be transferred to the appropriate Promoter (see Draw Schedule), giving our original entrants exactly the same number of chances to win the prize(s) of their choice.

The NHSFEST Raffle comprises of 36 separate society lotteries, one for each prize or group of prizes donated by each of the supporting artists and organisations from within the music industry. Each society lottery will be drawn in accordance with the DRAW SCHEDULE and will be promoted by either:

  • 1) The Prince & Princess of Wales Hospice (‘PPWH’), 20 Dumbreck Road, Glasgow, G41 5BW. Registered Scottish Charity No. SC012372. Licensed and regulated by the Gambling Commission (Licence No. 004947). www.gamblingcommission.gov.uk.. Responsible Person: Rhona Baillie; or
  • 2) Myton Hospice (Promotions) Limited (‘MHPL’), Myton Hamlet Hospice, Myton Lane, Warwick, CV34 6PX, a wholly owned subsidiary of The Myton Hospices (Registered Charity No. 516287). Licenced and regulated by the Gambling Commission. License No: 004889. www.gamblingcommission.gov.uk.. Responsible Person: Charlotte Ingram.

All proceeds go to the Promoter of each society lottery, who will distribute profits to help the NHS and UK based charitable partners.

  • 1. The NHSFEST Raffle will comprise of 36 separate society lottery draws, one for each prize(s) donated by each of the 36 supporting artists and organisations from within the music industry.
  • 2. Entrants understand that the promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, Instagram or any other social media based website, microblogging system or social media App.
  • 3. By entering the NHSFEST Raffle, you agree to a complete release of Facebook, Twitter and Instagram from connection with this raffle scheme.
  • 4. Your purchase of NHSFEST Raffle entries is from the Promoter of each society lottery, in accordance with these terms and conditions.
  • 5. All proceeds go to the Promoter of each society lottery, who will distribute profits to help the NHS and UK based charitable partners.
  • 6. All payments will be made remotely by Debit Card and will be processed utilising PPWH’s existing Level 1 PCI compliant Card Processing system, with PPWH acting in the sole capacity of a payment agent for any society lotteries promoted by MHPL.
  • 7. All profits will be distributed by the Promoter of each society lottery, to help the NHS and UK based charitable partners.
  • 8. You represent and agree that;
    • a. You are 18 years of age or over;
    • b. You are a resident of Great Britain or Northern Ireland;
    • c. You will not buy or purport to buy an entry to the NHSFEST Raffle on behalf of anybody under the age of 18; and
    • d. You will provide accurate entry information, including your name, personal address, telephone number and email address and accept that it is your responsibility to keep us informed of any changes as soon as they arise.
  • 9. You agree that you shall not be entitled to receive any prize if you are unable to substantiate to the Promoter your representations under paragraphs 8 (a), (b) and (c) above.
  • 10. You accept that PPWH and MHPL are licensed and regulated by the Gambling Commission under the Gambling Act 2005 and that in certain circumstances we may be unable to provide refunds or replacements once you have purchased your NHSFEST Raffle entries.
  • 11. The prizes offered in the NHSFEST Raffle can be viewed by clicking on each Artist’s name at www.nhsfest.co.uk. All prizes will be delivered to the winners at no additional cost to themselves, as soon as current circumstances permit and if an event related to a prize is cancelled or rescheduled, an alternative prize will be arranged, otherwise there are no alternatives to any of the prizes offered and no interest is payable. Entrants will be notified as to any change in the prize structure, via www.nhsfest.co.uk.
  • 12. The cost of each entry is £5. Participants may purchase more than one entry, but no more than 60. Payment must be made in advance, by Debit Card (following the recent change to Gambling Commission regulations which bans the use of paying for remote gambling by Credit Card, effective from 14th April 2020), via www.nhsfest.co.uk. Unique ticket or entry numbers will be confirmed by email.
  • 13. The Promoters may, without giving any reason or notice at their absolute discretion, decline to accept an application, cancel an existing entry, or terminate or suspend the NHSFEST Raffle.
  • 14. The NHSFEST Raffle will reopen at 18:00 on Friday 17th April and will close for entries at 18:00 on Sunday 19th April 2020, unless:
    • a. The gross proceeds from the PPWH society lotteries reaches £220k (£44k gross entries at £5 per entry), in which event entries into the PPWH society lotteries will be closed; or
    • b. The gross proceeds from the MHPL society lotteries reaches £7.5m (£1.5m gross entries at £5 per entry), in which event entries into the MHPL society lotteries will be closed.
  • 15. The Promoter will conduct the NHSFEST Raffle draws commencing from noon on Monday 20th April 2020. The draws will be made utilising a Random Number Generator (RNG) that has been tested and approved by an independent, Gambling Commission approved, third-party test house.
  • 16. The winning results will be published online, on Tuesday 21st April 2020, via www.nhsfest.co.uk/winners and winners will be notified by email or telephone, from Wednesday 22nd April 2020.
  • 17. No liability is accepted for the loss, theft or delayed receipt of any communication.
  • 18. The prizes are non-transferrable and hold no equivalent monetary value.
  • 19. PPWH operates a PPWH Complaints and Disputes Procedure.
  • 20. MHPL also operates an MHPL Complaints and Disputes Procedure.
  • 21. The Promoters are each committed to ensure that information about how to gamble responsibly and how to access information and help in respect of problem gambling is readily available to all. Please refer to the Responsible Gambling Guide.
  • 22. Nothing in these terms and conditions shall limit the Promoter’s liability for death or personal injury caused by its negligence, fraud or for any other matter for which liability may not be limited by law.
  • 23. The Promoters is not liable to you for:
    • a. Loss or damage, including the right to receive a prize, suffered by you if you have not complied with these rules, any relevant participation instructions or the rules and regulations of the Gambling Commission under legislation laid down in the Gambling Act 2005;
    • b. The Promoter’s failure or inability to contact you and/or award any prize due to any errors omissions or inaccuracies in the contact details you have provided or your failure to update these if they change;
    • c. Loss or damage incurred by you in connection with or arising from the use of the NHSFEST Raffle prizes or participation in the NHSFEST Raffle;
    • d. Any delays or failures in the NHSFEST Raffle website or any software, hardware or any other systems used by the Promoters for the administration of the NHSFEST Raffle;
    • e. Any failure or delay beyond the Promoter’s reasonable control.
  • 24. The Promoters are not liable to you in contract, tort (including but not limited to negligence) or otherwise in connection with the NHSFEST Raffle for loss of venue, contract, profits, anticipated savings or loss of data, any special or indirect or consequential losses or any loss of goodwill or reputation.
  • 25. All warranties, conditions or guarantees relating to the NHSFEST Raffle made by or on behalf of a Promoters whether express or implied by law, in the course of dealings or otherwise, are excluded to the maximum extent permitted by law.
  • 26. The Promoter’s liability to you shall be limited to the amount of any prize which has become due to you.
